  • Every truck your company enrolls for in the complaint must be purchased new, or leased, in the period between 1997 and 2016.

Taking legal action

If the producers do not want to come up with a solution, the court is the last instance. Since going to trial is both time-consuming and expensive – and not without risk at all – one mostly fails to take cases to court.

We think it’s wrong for truck manufacturers to get away with it, just because it’s cumbersome and risky for the customer to get them to pay a legitimate compensation. Cartel activity is illegal, and they have already been convicted by the European Commission.

Therefore, we will collect as many of those who have a claim as possible, and then in cooperation with skilled lawyers, demand back a legal compensation.

Registration

If you and your company wish to participate in the complaint, sign up now.


The registration fee is only EUR 98 per registered truck. This is next to nothing, but small streams make great rivers..

For this amount, you would probably only get a few minutes from a lawyer, and there is limited what that person could have accomplished at this time.

A minimum of 50% of the registration fee is set aside for the complaints process itself, while the rest goes to marketing, administration and operations.

We will also bring in supporters for the case, and the capital raised from them will go to the appeals process itself. We even cover the cost of rewarding the supporters.

Follow up

We gather the participants, sort them into different groups and keep all participants informed through regular newsletters, where we update on the progress of the work throughout the lifetime of the case.

We reserve the right to make additional payments, depending on how the case develops or what process becomes relevant. For example, it would be of great importance if we were to claim compensation for 100 or 10,000 trucks in the group complaint. Furthermore, the amount raised from the supporters will have a big impact, if there are few participants.

Experience shows that larger group complaints take around a year, from the first requests for compensation to be sent, until the case is fully clarified.

There are many advantages to standing together as a powerful group in the face of such large and resourceful counterparties. As the scam took place for a full 14 years, we should certainly be able to assemble a strong group.

Negotiation

We are working with lawyers, who will assist further in the process of finding a solution, if there is a need for legal clarification.

The lawyers will also assist in drawing up strategies for how the case should be resolved. Already upon registration, we set aside funds for the legal work.

All major complaints we have previously been involved in have been resolved by settlements, without expensive legal processes.

Result

If we win, you’ll receive 70% of the compensation. The remaining 30% goes to us and those who have helped us during the work – among them the supporters. This sharing model, in which we all win at the best possible result, ensures that we will all do our utmost to achieve the highest possible replacement.

By participating in the group, your company’s financial risk is limited to the enrollment fee.

This means that the process becomes far more affordable and contains a significantly lower risk than if you were to initiate a comprehensive complaints process on your own.

Should additional payment be applicable, this will be something you will decide on later in the process, based on the information that is then available. Our ambition is to make the process cost-saving and efficient.

Any additional payment will be deducted from our part of the compensation, so that your cost will maximum account for the registration fee, as well as 30% of the compensation.
